Order on Motion to Compel
ELECTRONIC ORDER denying in part and granting in part Plaintiff Chance E. Gordon's 97 Motion to Compel Further Discovery Responses.
First, the Court's 81 Standing Order on Discovery and Other Non-Dispositive Motions does not expand the scope of a privilege log requirement beyond documents withheld based on attorney-client or other recognized privileges or work product protection or otherwise expand the scope of Federal Rule of Civil Procedure 26(b)(5). It does not require a log for documents withheld on the basis of other objections.
Second, after carefully reviewing the briefing, the Court concludes that Defendants have sufficiently complied with Interrogatory Nos. 1, 2, and 14 and Request for Production Nos. 2, 3, and 4 to Defendant John Cavazos and with Interrogatory Nos. 1, 2, 6, and 10 and Request for Production Nos. 3, 4, 5, 6, and 13 to Defendant Tucker Albin & Associates, Inc. as to responsive documents that are within the scope of those requests. And the Court will not require sworn statements that are beyond the scope of what Federal Rule of Civil Procedure 34(b) requires.
But the Court will require that -- if either Defendant is withholding on the basis of any pending objections any documents in his or its possession, custody, or control that is (as to Cavazos) responsive to RFP Nos. 2, 3, or 4 or (as to Tucker) responsive to RFP Nos. 2, 3, 4, 5, 6, and 13 the defendant must, by July 2, 2026, serve a further amended or supplemental response to that request that fully complies with Rule 32(b)(2) and the Standing Order on Discovery and Other Non-Dispositive Motions. See Dkt. No. 81 at 5-11; Lopez v. Don Herring Ltd., 327 F.R.D. 567, 578 (N.D. Tex. 2018).
Finally, the Court determines that, under Federal Rule of Civil 37(a)(5), the parties will bear their own expenses, including attorneys' fees, in connection with this motion.
