Order on Motion for Sanctions
ORDER re: 118 Motion for Sanctions.
That portion of Plaintiffs' application seeking to lift the stay of deadlines and motion practice set by the Court on January 13, 2026 is granted.
With respect to the remaining issues, to wit: (1) motion for the imposition of sanctions under Rule 11 and/or 28 U.S.C. § 1927, and (2) application for attorneys fees by Plaintiffs counsel, and in order to avoid duplicity, counsel shall consolidate the motion for sanctions with any motion for attorney fees in accordance with the following briefing schedule:
Plaintiffs shall serve but not file their consolidated motion on or before October 16, 2026;
Defendants shall serve but not file their opposition on or before November 16, 2026;
Plaintiffs' reply, if any, will be due on or before November 30, 2026 at which point Plaintiffs will electronically file all motion papers.
In addition, the movant is reminded to mail to the Court one hard copy of all motion papers marked as "Courtesy Copy" as per the undersigned's individual rules. See Rule 11.c. The parties are reminded that courtesy copies must bear the ECF legend at the top of each page, indicating the case number, docket entry, file date and page number. All courtesy copies of exhibits and appendices must be submitted in clearly labeled three-ring binders and clearly labeled and tabbed.
