TEXT ORDER: The Court has reviewed the parties' July 27, 2026 letter. [D.E. 59]. For the reasons stated therein by both sides, Plaintiff may elect to either: (a) rely on the July 15, 2026 supplemental expert report of Dr. Benke and submit to a re-opened deposition by and supplemental report from Defendant; or (b) forego reliance on the July 15 Benke Report and testimony about its content at trial. On or before August 21, 2026, the parties shall file a joint letter in which Plaintiff states his decision concerning the July 15 Benke Report and in which the parties clarify whether they agree to consent to the jurisdiction of the magistrate judge in this action. As the parties are aware, consent is purely optional and the Court expresses no preference on the question by this inquiry. So Ordered by Magistrate Judge Andre M. Espinosa on August 16, 2026. (ame)
