ORDER denying without prejudice 1740 . On October 1, 2026, the Court denied Mr. Levitan's discovery motion at 1738 because the discovery motion did not contain a certification that the movant has met and conferred pursuant to Federal Rule of Civil Procedure 37(a)(1) and the Court's Individual Practices and Rules. See Text Order, dated Oct. 1, 2026. The Court further directed that any renewed motion shall contain a certification of conferral as well as the date and time of conferral.
Mr. Levitan filed a discovery motion at 1740 that does not contain the requisite certification, nor the statement of date and time of conferral. Indeed, there is no indication that any meaningful conferral occurred. Accordingly, 1740 is denied without prejudice to renewal.
