STIPULATION AND ORDER OF DISMISSAL: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and between the undersigned parties. by their respective counsel. and upon approval by the Court of the Stipulation and Order, as follows: I. The complaint is hereby dismissed, with prejudice and without costs or attorney's fees to any party. 2. The Stipulation and Order resolves all of Plaintiffs claims asserted in this action against the DOE. 3. The DOE agrees to reduce by$ I 0,000 the principal amount owed only under NSLDS Loan No. I, with the other terms of NSLDS Loan No. I unaffected and remaining in place. The terms under NSLDS Loan No. 2 are not affected by the parties' agreement as to NSLDS Loan No. I. 4. The Stipulation and Order is subject to the approval of the Court. If the Court declines to approve the Stipulation and Order, it shall be null and void, with no force or effect. 5. The undersigned parties understand and agree that the Stipulation and Order contains the entire agreement between them, and that no statements, representations, promises,agreements or negotiations, oral or otherwise, between the undersigned parties or their counsel that are not included herein shall be of any force or effect. 6. This Stipulation may be executed in counterparts; a reproduced signature shall have the same force and effect as an original signature; and a facsimile or electronic copy of the Stipulation and Order shall have the same force and effect as an original.
