The Court has received numerous pro se filings concerning a closed case.
I. BACKGROUND/PROCEDURAL HISTORY
On August 26, 2020, Plaintiff Romspen Investment Corporation ("Plaintiff Romspen") filed the First Amended Complaint seeking foreclosure of a large tract of land on the Big Island of Hawaii.
The foreclosure complaint was filed against the following Defendants:
(1) JPL Hawaii, LLC;(2) Brian Anderson, individually;
(3) Iolani Islander, LLC;
(4) Superior Investments XIX, Inc.;
(5) Dominis Anderson, as Trustee, under that certain trust agreement dated May 14, 2018, and known as the GC Irrevocable Trust and under that certain trust agreement dated May 14, 2018, and known as the BC Irrevocable Trust;
(6) Kukulu, Inc., and
(7) Kukulu Investment Fund.
(First Amended Complaint ("FAC"), ECF No. 12 ).
A. Subject Property Developers: JPL Hawaii, LLC,Brian Anderson, and Iolani Islander, LLC
Beginning in October 2015, a series of loans were made to Defendant JPL Hawaii, LLC from Romspen related to the Subject Property. Brian Anderson served in a management role with JPL Hawaii, LLC and Iolani Islander, LLC, and he was one of the guarantors on the loans. JPL Hawaii defaulted on the loans and Romspen sought foreclosure of the Subject Property.
B. Additional Loan Guarantors: Superior Investments XIX, Inc. and Dominis Anderson
The guarantors on the loans to JPL Hawaii, LLC included Brian Anderson, Iolani Islander, LLC, Superior Investments XIX, Inc., and Dominis Anderson as trustee to two separate irrevocable trusts.
C. Additional Entities With Interest In The Subject Property: Kukulu, Inc. and Kukulu Investment Fund
Kukulu, Inc. and Kukulu Investment Fund were also named in the Complaint because they had entered into two Development Agreements with JPL Hawaii to develop lots on the Subject Property.
D. The Subject Property Was Foreclosed And Romspen Purchased The Property At The Foreclosure Sale
The foreclosure proceedings were completed in the case and a decree of foreclosure was entered on November 5, 2021,pursuant to a STIPULATED FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER GRANTING PLAINTIFF ROMSPEN INVESTMENT CORPORATION'S MOTION FOR SUMMARY JUDGMENT AND INTERLOCUTORY DECREE OF FORECLOSURE AGAINST ALL PARTIES. (ECF No. 141 ).
A foreclosure commissioner was appointed on December 1, 2021, pursuant to a STIPULATION AND ORDER REGARDING APPOINTMENT OF FORECLOSURE COMMISSIONER RELATED TO THE FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER GRANTING PLAINTIFF ROMSPEN INVESTMENT CORPORATION'S MOTION FORSUMMARY JUDGMENT AND INTERLOCUTORY DECREE OF FORECLOSURE AGAINST ALL PARTIES. (ECF No. 151 ).
The sale of the property was confirmed at auction to Romspen on June 13, 2022, pursuant to an ORDER GRANTING MOTION FOR ORDER APPROVING REPORT OF COMMISSIONER, CONFIRMING SALE OF REAL PROPERTY AT PUBLIC AUCTION, DIRECTING DISTRIBUTION OF PROCEEDS, AND FOR ISSUANCE OF A WRIT OF EJECTMENT. (ECF No. 229 ).
E. Proceedings Were Concluded As To SuperiorInvestments XIX, Inc. and Dominis Anderson Following The Foreclosure Sale
The proceedings as to the loan guarantors Superior Investments XIX, Inc. and Dominis Anderson were concluded with the Order of Sale. (See ECF No. 212 ).
F. Romspen And Kukulu Litigated Following The Foreclosure Sale And Entered Into A Settlement On The Record
