Report and Recommendations
REPORT & RECOMMENDATIONS re 56 , 59 , 66 : For the reasons stated in the attached Report and Recommendation, the Court respectfully recommends that Plaintiff's motion to enforce judgment at ECF No. 56 should be granted in that judgment should be entered against Defendants Robert Eliodromytis and K & T Provisions, Inc. jointly and severally in the amount of $36,060.00, including $23,000.00 for outstanding principal, $10,000.00 for liquidated damages, and $3,060.00 for attorneys' fees incurred for enforcement of the parties' Agreement. The Court also respectfully recommends that defense counsel Albert Rizzo, Esq.'s motion to withdraw representation at ECF No. 66 should be granted, and his related letter motion for leave to file under seal at ECF No. 59 should be denied as withdrawn.
A copy of this Report and Recommendation is being served on all parties via ECF. In an abundance of caution, attorney Rizzo shall serve a copy of this Report and Recommendation on Defendants and file an affidavit of service within one business day of this Report and Recommendation.
Within 14 days of service, any party may serve and file specific written objections to this Report and Recommendation. 28 U.S.C. § 636(b)(1)(C); Fed. R. Civ. P. 72(b). Any requests for an extension of time to file objections shall be directed to Judge Kuntz. If a party fails to object timely to this Report and Recommendation, it waives any right to further judicial review of this decision. See Miller v.
