ORDER denying without prejudice 11 Motion to Dismiss. The court previously stayed this action, noting that either party could move to reopen the case upon disposition of a related state court appeal. See ECF No. 31 (May 19, 2025). It appears that the state proceedings resolved a year ago, with no subsequent action from the parties in the present matter. See Cruz v. Waterbury, 235 Conn. App. 259 (2025); cert. denied at 353 Conn. 931 (2025). Accordingly, the court hereby denies without prejudice the pending motion to dismiss, and the parties still remain free to seek further relief from the court. If neither party seeks any such further relief on or before October 30, 2026, the action will be deemed dismissed with prejudice without any further order of the court. It is so ordered.
