FINAL JUDGMENT AS TO DEFENDANT ANNETTE BONGIORNO:IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that Defendant ispermanently restrained and enjoined from violating Section 17(a) of the Securities Act of 1933(the "Securities Act") [15 U.S.C. 167; 77q(a)] in the offer or sale of any security by the use of anymeans or instruments of transportation or communication in interstate commerce or by use of themails, directly or indirectly: and further set forth in this Order. IT IS FURTHER ORDERE D, ADJUDGED, AND DECREED that Defendant isliable for disgorgement and prejudgment interest of $24,017,874. This disgorgement andprejudgment interest shall be deemed satisfied by the $155,158,703,200 in restitution orderedagainst Defendant i n United States v. O'Hara et al., 10 Cr. 228 (S.D.N.Y.) (LTS), and the FinalOrder of Forfeiture entered in that action. IS FURTHER ORDERED, ADJUDGED, AND DECREED that no civil penaltyshall be ordered against Bongiorno in this civil action, based on Defendant's criminal conviction,Final Order of Forfeiture and sentence in United States v.
