Order on Motion to Remand to State Court
ORDER: Before the Court is Plaintiffs' Motion to Remand. ECF No. 8 . Having reviewed the Motion and applicable law the Court finds that it should be and hereby is GRANTED in part. On May 30, 2025, Defendants Byrd Group, LLC and Fore Those Who Serve, LLC, removed this case based on diversity jurisdiction claiming that they are both citizens of Florida and Plaintiffs are citizens of Texas. However, as pointed out in Plaintiffs Motion, Defendants omitted the presence and citizenship of the third Defendant in the declaratory action-Peter Wiebe. See ECF No. 1 - 5 at 4. This Court has diversity jurisdiction over civil actions where the matter in controversy exceeds the sum or value of $75,000, exclusive of interest and costs, and is between citizens of different states." 28 U.S.C. § 1332. Because Mr. Wiebe is a citizen of Texas and, thus, a resident as the same state as Plaintiffs the Parties are not citizens of different states. Therefore, Defendants' removal was improper. Accordingly, it is ORDERED that this case is hereby REMANDED to the 231st Judicial District Court of Tarrant County, Texas. (Ordered by Judge Mark Pittman on 6/10/2025) (sre)
