Notice of Deficiency
NOTICE OF DEFICIENCY regarding 125 Motion to Seal Document. Pursuant to Local Civil Rule 79.2(b) -...all proposed sealed documents must be accompanied by a motion to seal. The motion to seal shall be a public document and noted with a docket entry that gives the public notice of the request to seal. The docket entry for the proposed sealed document shall identify it as a proposed sealed document and describe the type of document it is (e.g., affidavit, record) and the substantive motion or other specific proceedings in the case to which it relates (e.g., in support of defendants motion to compel at D.E. ____). The proposed sealed document is deemed to be provisionally sealed until the court rules on the motion to seal. The proposed sealed document must be filed first, then the motion to seal should be filed linking to the proposed sealed document. Counsel shall refile also remembering to include a proposed order for the court.
Counsel is also reminded of Standing Order 25-SO-1 found on our website. Service of Sealed Documents Filed in CM/ECF. Because sealed documents filed in CM/ECF will no longer be accessible or viewable electronically, service cannot be accomplished through CM/ECF. Parties will have to serve sealed documents by other appropriate means as provided by the Federal Rules of Procedure. The court will serve sealed documents in paper by mail. (Collins, S)
