FINAL JUDGMENT AS TO DEFENDANT LAWRENCE BILLIMEK: The Securities and Exchange Commission having filed a Complaint and Defendant Billimek having entered a general appearance; consented to the Courts jurisdiction over Defendant and the subject matter o f this action; consented to entry of this Final Judgment; waived findings of fact and conclusions of law; and waived any right to appeal from this Final Judgment: IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Defendant is liablefor disgorgement o f $12,684,000, representing net profits gained as a result of the conductalleged in the Complaint. This obligation shall be deemed satisfied by entry of the orders offorfeiture and restitution in a related criminal case, United States v. Lawrenc e Billimek, 22 Cr. 675 (PGG) (S.D.N.Y.) (Doc. 90, 117). IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that this Court shall retain jurisdiction of this matter for the purposes of enforcing the terms of this Final Judgment.
