Order on Motion for Miscellaneous Relief
PAPERLESS ORDER. THIS CAUSE came before the Court upon the Parties' Joint Motion to Permit Attendance at Mediation via Video Conference. 26 . Therein, the Parties request they be allowed to mediate remotely, because the Parties' selected mediator "is currently residing in North Carolina and conducting mediations remotely via videoconference technology from that location." Id. at 2. Further, the Parties state that their attorneys and selected mediator each "have extensive experience conducting successful mediations via video conferencing technology and are confident in their ability to meaningfully participate and negotiate in good faith via this method." Id. Finally, the Parties note that the Parties, their representatives, and their counsel will all "be present and available during the mediation and will have full authority to settle the case." Id. When the Court referred this matter to mediation, it ordered that "[t]he physical presence of counsel and each party with full authority to enter in a full and complete compromise and settlement is mandatory" and "[t]he mediation shall take place in person absent good cause shown by the parties." (ECF No. 17). Here, the Court finds the Parties have not shown good cause. The Court directs the Parties to attempt to find a mediator who will conduct mediation in-person. Should the Parties fail to do so, they may file another Motion with the Court, with proof of their failed efforts to find a mediator who conducts in-person mediations, seeking either an extension or to conduct mediation remotely. Such proof shall also include correspondence from the currently selected mediator or his offices indicating he will not allow the Parties to mediate in person or indicating when he returns to Florida and if he allows parties to mediate in person at that time. Accordingly, UPON CONSIDERATION of the Joint Motion, the pertinent portions of the record, and being otherwise advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 26 is DENIED without prejudice.
