AMENDED TEXT ORDER: The Court has reviewed the parties' pre-motion practice relating to defendants' request to move to dismiss at ECF No. 3 and ECF No. 5 and plaintiffs' request to move for partial remand (ECF No. 4 ) to which defendants have not responded. Plaintiffs' letter at ECF No. 4 does not identify a defect in removal or a lack of jurisdiction warranting remand pursuant to 28 U.S.C. § 1447(c). Their request to move to remand is therefore denied without prejudice. Defendants' request to file a motion to dismiss is granted. Defendants shall file their proposed motion no later than September 2, 2026. The parties' position that the Court should not exercise jurisdiction over state-law claims in the event that the federal claims are dismissed (ECF No. 3 p. 4; ECF No. 5 p. 3) will be considered in due course as part of the Court's ruling on the forthcoming motion.
