MINUTE entry before the Honorable Young B. Kim:Status hearing held. Defendant reported that he is unwilling to sign the final version of the settlement agreement. Plaintiff responded that it wishes to file a motion to enforce the agreement. The court discussed with the parties the following three options to move this issue forward: (1) Plaintiff to litigate the matter and seek both monetary and injunctive relief; (2) Plaintiff to file a motion to enforce the settlement agreement it signed on May 13, 2026; and (3) parties to confer further on Paragraph 2(d) of the settlement agreement. Plaintiff declined options (1) and (3) at this time. The court urges Defendant to examine the settlement communications, the court's May 4, 2026 order (R. 49), and actions Defendant took in response to the order and then confer with Plaintiff if there is anything else he may be able to do (e.g., signing the settlement agreement) to avoid motion practice. Plaintiff has until July 1, 2026, to file its motion to enforce, and any request for fees must be properly supported. If Plaintiff timely files a motion, Defendant has until July 15, 2026, to file a response. Parties are granted leave to file settlement communications under seal. If they include the substance of those communications in their motion and response, the parties must file unredacted versions under seal and redacted public versions at the same time.
