EO: On 8/31/2026, this Court noted Plaintiff's counsel's failure to respond to Defendant Sheri J. Tanaka regarding outstanding discovery. Due to Plaintiff's counsel's lack of response, Defendant Tanaka filed the 279 Motion to Compel Further Responses and Production of Documents (Motion) without first meeting and conferring with Plaintiff's counsel.
As a result, the Court directed Plaintiff's counsel to contact Defendant Tanaka no later than 9/2/2026 to schedule the meeting required by Local Rule 37.1(a). According to Defendant Tanaka's 285 Status Report, "Defendant Tanaka has received no telephone call, missed call, voicemail, e-mail, or other communication from Plaintiff's counsel seeking to schedule the meeting required by Local Rule 37.1(a)."
In light of the foregoing, Plaintiff's counsel is ORDERED TO SHOW CAUSE why the Motion should not be granted in its entirety due to Plaintiff's counsel's failure to contact Defendant Tanaka to meet and confer about the Motion and to respond to Defendant Tanaka's requests to meet and confer about outstanding discovery. Plaintiff's counsel's response to this order to show cause is due on 9/9/2026.
Lastly, the Court DISCHARGES the requirement for Defendant Tanaka to file a Status Report by 9/14/2026, as required in ECF No. 280.
