TEXT MINUTE ENTRY for telephonic status conference held before Magistrate Judge Ryan C. Carson on August 27, 2026. Richard Hitz appeared for Plaintiff. Alex McKenna and Sean Hamer appeared for Defendant. The parties reported that case progression remains on track, with Defendant's dispositive motion to be filed by the current deadline. The matter is ready to set for trial. The parties agree the case may be tried in four (4) days rather than five (5). A separate trial setting order is forthcoming. The parties also discussed interest in mediation. Plaintiff has extended a settlement demand. Defendant stated that it may be amenable to mediation following resolution of the anticipated dispositive motion. The court encouraged the parties to pursue settlement discussions and offered the availability of a court-supervised settlement conference should the parties agree to participate. Order Setting Hearing or Trial
TRIAL SETTING ORDER - The jury trial of this case is set to commence before Robert F. Rossiter, Jr., United States District Judge, in Courtroom 4, Roman L. Hruska Federal Courthouse, 111 South 18th Plaza, Omaha, Nebraska, at 9:00 a.m. on April 12, 2027, or as soon thereafter as the case may be called, for a duration of four (4) trial days. This case is subject to the prior trial of criminal cases and such other civil cases as may be scheduled for trial before this one. Jury selection will be held at the commencement of trial. The Pretrial Conference is scheduled to be held before the undersigned magistrate judge on March 11, 2027 at 11:00 a.m., and will be conducted by internet conferencing. Conferencing instructions will be provided by the court prior to the conference. The parties' proposed Pretrial Conference Order and Exhibit List(s) must be emailed to carson@ned.uscourts.gov, in Word format, by 5:00 p.m. on March 3, 2027. Ordered by Magistrate Judge Ryan C.
