ORDER: In the courts August 25, 2020 order, it directed the parties to submit a proposed consent amended scheduling order to provide additional time for discovery, if needed, on two identified issues. Since that time, the parties have been unable to come to an agreement on whether additional time for discovery is needed. [ECF No. 35 ] Given the disagreements between the parties, the court is directing both parties to move for leave to amend the scheduling order by 12/2/2020. The motion and corresponding proposed schedule should set forth the parties positions on whether discovery is needed and the proposed dates for the remainder of the case.
