Minute Order Order on Motion for Protective Order Order on Motion for Miscellaneous Relief
MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 10/7/2026: Plaintiff Hersey's motion for a protective order (ECF No. 74 ) to stop the Rule 30(b)(6) depositions is DENIED. It appears that three of the five depositions were scheduled for October 5 & 6, 2026, and may have already occurred prior to this motion being docketed on the afternoon of October 6. As to depositions that may have already occurred, any dispute would be moot. For the remaining depositions, the motion does not demonstrate good cause for the entry of a protective order. Plaintiff Hersey is not being deposed. These are depositions noticed by other parties. Plaintiff Hersey appears to take issue with the topics of the depositions and that they were amended the week before the depositions. However, Plaintiff Hersey also states "I agree with these topics. They cover what I wanted." ECF No. 74 at 6. Plaintiff's contention that she had only a few days to prepare on these additional topics, which she claims she wanted, does not demonstrate the "annoyance, embarrassment, oppression, or undue burden or expense" (Fed. R. Civ. P. 26(c)(1)) necessary for entry of a protective order. To the extent Plaintiff Hersey believes that the other parties are not complying with the rules of discovery, she may request that the Court set an informal discovery conference pursuant to Magistrate Judge Riordan's Civil Standing Orders or may file a motion seeking clearly-identified relief. (Deputy Clerk SH)
