Kness: In view of the ongoing issues relating to the status of Plaintiff's representation (see, e.g., Dkt. 79 , 85 , 92 ), Defendant's motion for summary judgment 68 is dismissed without prejudice to refiling once it is determined whether substitute counsel will appear on Plaintiff's behalf. If Plaintiff obtains new counsel, the Court will need to determine whether to permit Plaintiff another chance to respond substantively to the motion for summary judgment (Plaintiff did not file a response despite being given the opportunity to do so). If Plaintiff does not obtain new counsel, or if the Court determines that briefing on the motion for summary judgment should otherwise not be reopened, Defendant will be permitted to reinstate its motion for summary judgment based on the present briefing.
