TEXT ORDER: Judge Beaton held a remote status conference with the parties over Zoom on July 22, 2026. Tiffany Harrod spoke on behalf of the Plaintiffs, Harold Mac Johns on behalf of the County Defendants, and Justin Schaefer on behalf of the City County Planning Commission Defendant. As discussed on the record, the Court ordered the Plaintiffs to respond to the motion to dismiss (DN 37 ) by July 24, 2026, on the expectation that the Plaintiffs would combine such a response with their anticipated request for temporary emergency relief. The Court further ordered the Defendants to respond to that anticipated filing by August 3, 2026, and ordered the Plaintiffs to submit a reply brief by August 7, 2026. Insofar as the Planning Commission intends to file its own motion to dismiss or otherwise respond to the Plaintiffs' anticipated request for emergency relief, it should conform any such filing, as much as practicable, to the briefing schedule set out in this order.
