ORDER APPROVING WRONGFUL DEATH SETTLEMENT - IT IS HEREBY ORDERED that Plaintiff Cole, Plaintiff Jameson, and Defendant Freeway Logistics' Joint Petition for Approval of Wrongful Death Settlement, (Doc. 193 ), is GRANTED. IT IS FURTHER ORDRED that Plaintiffs' cause of action and all claims for any injuries, damages or losses against Defendant Freeway Logistics arising from or surrounding the death of Raina Jamerson be, and hereby are, settled for the amounts set forth in the parties' respective Releases of All Claims (Docs. 193 -1, 193 -2), inclusive of attorneys' fees and costs, the consideration agreed upon by the parties. IT IS FURTHER ORDERED that Defendant Freeway Logistics shall tender the settlement proceeds to Plaintiffs within thirty (30) days of the date of this Order. See MO. REV. STAT. § 537.095.4(1). IT IS FURTHER ORDERED that Plaintiffs shall deduct and pay the expenses of recovery and the attorneys' fees as contracted and described in the Settlement Disbursement Schedule, (Doc. 193 -5); see MO. REV. STAT. § 537.095.4(2). IT IS FURTHER ORDERED that within fourteen (14) days of Defendant Freeway Logistics' tendering of the settlement proceeds to Plaintiffs, Plaintiffs shall execute and file with the Court an acknowledgment of satisfaction. See MO. REV. STAT. § 537.095.4(3). That acknowledgement shall affirm that the settlement proceeds have been distributed in the manner described within the Settlement Disbursement Schedule, (Doc. 193 -5); See MO. REV. STAT. § 537.095.4(4)-(5). IT IS FURTHER ORDERED that no later than thirty (30) days after filing the acknowledgment of satisfaction with the Court, Plaintiffs and Defendant Freeway Logistics shall file the appropriate dismissal documents with respect to Plaintiffs' claims against Defendant Freeway Logistics. See FED. R. CIV. P. 41(a)(2). IT IS FURTHER ORDERED that Plaintiffs and Defendant Freeway Logistics' Joint Motion for Leave to File under Seal, (Doc. 191 ), is GRANTED. IT IS FINALLY ORDERED that the Sealed Memorandum in Support of Joint Motion for Leave to File under Seal, (Doc. 192 ), the Releases of All Claims (Doc. 193 -1, Doc. 193 -2), and the Settlement Disbursement Schedule, (Doc. 193 -5), shall remain under seal indefinitely.
