Judge Allison D. Burroughs: ELECTRONIC ORDER ENTERED. Plaintiffs have moved for voluntary dismissal without prejudice of certain representative plaintiffs (collectively, “Withdrawing Plaintiffs”) pursuant to Federal Rules of Civil Procedure 21 and 41(a)(2), [ECF No. 1829 ]; see also [ECF Nos. 1830 , 1864 , 1865 ], and Defendants have opposed the motion, [ECF No. 1841 ]. The Court has dismissed Brinitha Harris without prejudice, [ECF No. 1853 ], and the pending dispute and this Order relate to nine individuals. See [ECF No. 1864 at 2 n.1].Rule 41(a)(2) provides that “an action may be dismissed at the plaintiff's request only by court order, on terms that the court considers proper.” Fed. R. Civ. P. 41(a)(2). This Court, like other similarly situated transferee courts, “find[s] that granting [Plaintiffs’] motion for voluntary dismissal without prejudice would lead to legal prejudice to [Defendants],” and, accordingly, “find[s] that a proper term of dismissal under Federal Rule of Civil Procedure 41(a)(2) is to dismiss [Plaintiffs’] claims with prejudice.” In re Marriott Int’l, Inc., Customer Data Sec. Breach Litig., No. 19-md-02879, 2021 WL 3883265, at *6 (D. Md. Aug. 31, 2021); see alsoIn re Anthem, Inc. Data Breach Litig., No. 15-md-02617, ECF No. 700 at 4­-8 (N.D. Cal. Feb. 3, 2017). The Court therefore GRANTS IN PART and DENIES IN PART Plaintiffs’ motion and dismisses with prejudice the claims of the following Withdrawing Plaintiffs: Mark Young, Robert Plotke, Hannah Polikowsky, John Meeks, Denise Meyer, Lynda Hale, Camille Burgan, Eugene Burgan, and Keith Bailey. Because it would be impracticable to condition these dismissals upon compliance with discovery obligations as requested by Defendants as to some Withdrawing Plaintiffs, see [ECF No. 1841 ], and because the Court does not find that the absence of such a condition would cause substantial prejudice to Defendants, the Court relieves all Withdrawing Plaintiffs from discovery obligations related to the instant litigation effective immediately.
