Order on Motion for Extension of Time
PAPERLESS ORDER granting in part and denying in part 60 the Parties' Joint Motion to Modify Scheduling Order and Trial Date. The Parties have jointly submitted a revised pretrial litigation schedule, which modestly extends the pretrial dates within the current scheduling order (DE 16 ). However, they also request a two-month extension of the trial date, from July 1, 2024, to September 9, 2024. In support, the Parties represent that defense counsel has a family wedding on July 12, and counsel for both sides has preplanned attorney time off the remainder of July and August. I will grant the request to extend the pretrial litigation schedule and adopt the dates the Parties have submitted. Such dates are agreed upon and do not seem to impact the currently scheduled trial date. However, I decline to extend the trial by the two months requested. In light of the representation that defense counsel's wedding is on July 12, which would be the last day of the two-week trial period, the conflict would not interfere with the majority of the trial period. Moreover, I will consider a specially set trial date at the beginning of the trial period should that help the Parties for planning purposes. Accordingly, at this time I will leave the trial date intact and adopt the Parties' proposed revisions to the Pretrial Scheduling Order. Of immediate importance, the new deadline for the Parties to file all pretrial motions is May 16, 2024. Lastly, the Parties are reminded that should they desire greater flexibility in the litigation schedule or the trial date, they may at any time consent to the jurisdiction of the paired Magistrate Judge. The consent form can be found at Appendix A of the Pretrial Scheduling Order (DE 16 ). Signed by Judge Donald M. Middlebrooks on 4/26/2024. (kid)
