ENDORSED ORDER granting 34 plaintiff's unopposed motion for leave to join a non-diverse party as a defendant and 8 plaintiff's motion to remand. Defendant's consent to the joinder of a non-diverse defendant requires remand. Plaintiff may file her amended complaint and a waiver or return of executed service as to Xiomara Fonseca in the state-court matter. The clerk is directed to REMAND this case back to state court by transmitting a certified copy of this order to the clerk for Florida's Twentieth Judicial Circuit in and for Lee County with respect to state-court case number 2024-CA-7029.
