TEXT ORDER entered by Chief Judge Sara Darrow on May 10, 2024. Plaintiff filed a 167 Motion for Leave to File Excess Pages in Its Opposition to Motion for Summary Judgment ("Motion for Excess"). The argument section of Plaintiff's 164 Opposition to Defendant's Motion for Summary Judgment is 47 pages, which is 32 pages over the 15-page limit set by Local Civil Rule 7.1(B)(4)(a). Mot Excess 1; see also Civil LR 7.1 (D)(5) (requiring that argument sections in summary judgment responses adhere to Local Civil Rule 7.1(B)(4)(a)). Plaintiff notes that the operative complaint alleges six causes of action, spanning seven years of events and implicating five different decisionmakers of Defendant, which is further complicated by the regulatory framework applied to nuclear power companies and the Supreme Court's recent decision in Murray v. UBS Securities, LLC, 601 U.S. 23, 144 S. Ct. 445 (2024). Mot. Excess 12. The Court previously gave Defendant leave to file excess pages in its 143 Motion for Summary Judgment based on similar considerations. See Feb. 22, 2024 Text Order. Defendant does not oppose the 167 Motion for Excess. 168 Resp. Mot. Excess 1. The Court GRANTS the 167 Motion for Excess. Plaintiff's 164 Opposition to Defendant's Motion for Summary Judgment is deemed properly filed, but counsel is reminded that the proper procedure for filing documents requiring leave of Court is specified in Local Civil Rule 7.1(F), which requires that "the filing party must attach the proposed document as an exhibit to a motion to file."
