Scheduling Order
SCHEDULING ORDER: A video settlement conference is scheduled for 11/16/2026 at 2:30PM before Magistrate Judge Marcia M. Henry. Plaintiffs' corporate representative with full settlement authority; representatives of the Corporate Defendants with full settlement authority; Individual Defendants Naiyer Imam, Pervaiz Qureshi, and Robert Solomon; and counsel must attend. The parties shall submit their confidential ex parte settlement positions to henry_chambers@nyed.uscourts.gov no later than 11/09/2026. With their submissions, counsel must also provide email addresses and phone numbers for counsel and clients to the Court so that the Court may connect the parties to a video conference. Counsel shall review and comply with the Court's Standing Order for Settlement Conferences in preparation for the conference, which is available on the Court's website. MINUTE ENTRY for proceedings held before Magistrate Judge Marcia M. Henry: An in-person status conference was held in this case on 09/16/2026. Max Gershenoff appeared on behalf of the Plaintiffs. Jessica Sprague appeared on behalf of Defendants Star Medical Diagnostic, P.C., New York Medical & Diagnostic Care, P.C., Pervaiz Qureshi, M.D., Robert Solomon, M.D. (the "Star Medical" Defendants). Ruth Kraft and Marlena Smith appeared on behalf of the Defendants American Medical Initiatives, P.C., and Naiyer Imam, M.D (the "AMI" Defendants).
The parties report that fact discovery has been completed. Accordingly, fact discovery is certified as closed. The parties report that the AMI Defendants produced the disputed DICOM images addressed in the parties' motions and that they anticipate expert discovery and depositions. Accordingly, the Court granted in part and denied in part the parties' motions for extensions of time to complete discovery 90 , 94 , and Plaintiff's letter motion to compel discovery 91 .
The parties expressed interest in settlement discussions after the disclosure of affirmative expert reports. Therefore, the parties shall appear for a settlement conference on 11/16/2026 at 02:30 PM, for which a separate scheduling order shall issue. So Ordered by Magistrate Judge Marcia M.
