STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE PURSUANT TO RULE 41(a)(1)(A)(ii): NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by andbetween the undersigned, that the above-referenced action is hereby dismissed with prejudicepursuant to Rule 41(a)(1)(A)(ii); and notwithstanding the dismissal of this action in accordancewith this agreement, the District Court shall continue to retain jurisdiction over this action for thepurpose of enforcing the terms of the settlement agreement reached between the parties and setforth in the Stipulation of Settlement by the parties in this matter. STIPULATION OF SETTLEMENT: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the Parties, through the undersigned, as follows: The City of New York shall pay FORTY SEVEN THOUSAND TWO HUNDRED FIFTY DOLLARS AND ZERO CENTS ($47,250.00) in full satisfaction of all claims for attorneys' fees, costs, and expenses, incurred or accrued in connection with school year 2020-21 including IH Case No. 223216 and the instant federal action. As further set forth in this order. Nothing contained herein shall be deemed to be an agreement or admission by Defendant or the City of New York as to the reasonableness of the number of hours billed or the hourly rates claimed by Plaintiffs counsel. The Agreement is final and binding on all Parties, as well as their successors and assigns. This document may be executed in subparts, and, whether or not it is executed in subparts, a signature received by facsimile or electronic mail shall have the same force and effect as an original signature.
