Stipulation and Order of Voluntary Dismissal
STIPULATION OF DISMISSAL WITH PREJUDICE The matter in the above-captioned action having been amicably resolved by and between plaintiff Brian Calise ("Plaintiff") and defendant Casa Redimix Concrete Corporation ("Defendant"), it is hereby stipulated and agreed, pursuant to Federal Rule of Civil Procedure 41 (a), that the case against Defendant shall be, and hereby is, dismissed with prejudice and without costs or attorneys ' fees against any party. The Court accepts this stipulation of dismissal under Federal Rule of Civil Procedure 41(a)(1)(A)(ii), which allows the parties to file sign and file a stipulation of dismissal to voluntary dismiss a case.
