Order on Motion for Discovery
ORDER denying 66 -- Defendants' request to file a motion to dismiss or compel is denied. The Court already has determined that Plaintiff's medical treatment and history is relevant and has ordered plaintiff to provide authorizations for prior surgeries and anesthesia treatment she underwent subsequent to the events at issue in the complaint, and, to the extent it has been put at issue by the allegations in the complaint, her history of drug treatment. See Dkt. No. 62 at 11:2-14:11 ("Plaintiff does need to provide medical authorization. Her medical treatment...injuries, history is relevant to her claims here and certainly to damagesprior surgeries, prior anesthesia, and...also her history of drug treatment given the way that it's been put at issue in the complaint. I think she needs to provide all of those...[I]n general, the authorizations should be provided.") The parties are directed to meet and confer regarding the date ranges of the authorizations. To the extent defendants seek additional authorizations, the parties are directed to meet and confer to reach agreement on the subject matter and time frame of the authorizations with each party proposing specific language it believes is appropriate. The parties may include an update on the status of authorizations in the joint status report due on or before July 13, 2026. (See Minute Entry, dated 5/18/2026). The parties are reminded that if they cannot agree on the contents of the joint status report, each party's portion of the joint letter is limited to two pages. After reviewing the July 13 status report, the Court will notify the parties if a conference or additional briefing is necessary. So Ordered by Magistrate Judge Peggy Cross-Goldenberg on 6/22/2026.
