Amos has neither alleged that Ferguson or El-Khoury were state actors, nor has he alleged that Anna was incarcerated. As a result, he has not stated a claim under the Eighth Amendment.For these reasons the District Court should dismiss his claims against these defendants. TEXT ORDER: Pending before the Court is the parties' joint motion for leave to mediate virtually 104 , which was filed just two days before mediation is scheduled to occur. In the Court's long experience, both at the bar and on the bench, it has found such mediations to rarely, if ever, be successful. Therefore, although the motion is GRANTED, if the case is not settled, the Court will likely order an in-person mediation. Again, the Court is of the firm opinion this is a case that would and could be settled, given another good faith effort by the excellent counsel in this matter. IT IS SO ORDERED.
