Order: The Court SCHEDULES a contempt hearing against the custodians of certain records identified in the Order on August 18, 2026 at 10:00 a.m. eastern in Courtroom 16B, Carl B. Stokes U.S. Courthouse, 801 West Superior Avenue, Cleveland, Ohio. The Court ORDERS the custodian or another representative of each Entity with knowledge of its responses to the requests for records for their associated Plaintiffs to appear and to produce the records at issue by August 10, 2026 and ORDERS the requesting party to serve this Order on the custodians, representatives, or personnel of each Entity with whom he or she has been dealing and to certify service. Minute Order _ Status Conference
Minutes and Order: On July 1, 2026, the Court held a status conference on the record at which the Court and counsel addressed the items on the agenda (ECF No. 771 ). Regarding third-party discovery, by separate Order, the Court will compel the Entities subject to the Order to Show Cause (ECF No. 758 ) to produce the requested documents under penalty of contempt. The Court sets a deadline of July 13, 2026 for any motions for contempt and schedules a contempt hearing for August 18, 2026 at 10:00 a.m. in Courtroom 16B. Defendant made an oral motion to dismiss the claims of Plaintiffs Angela Hill, Amber Paulson, and Nemer Mohammad because the time for them to substitute parties has passed. The Court ORDERS these Plaintiffs to respond by August 15, 2026. With respect to selection of the Core Discovery Pool, counsel outlined their respective views on how to proceed based on the response rates in the Record Collection Pool and the random selections. The Court outlined its views of how to proceed and extended the deadline for submission of selections to July 6, 2026. Counsel argued their respective positions regarding Interrogatories No. 1 and No. 23. For the reasons stated on the record, the Court found that Defendants discharged their obligations under Rule 33 with respect to Interrogatory No. 1 but noted that the PLC has other discovery tools to obtain that information if they decide to pursue them. With respect to Interrogatory No. 23, the Court declined to compel production of this financial information. Additionally, the Court explained that it views motions to substitute parties as best handled on remand to transferor courts and outlined how it will handle such motions.
