Minute Entry for proceedings held before Magistrate Judge Jose R. Almonte. A status conference was held on April 29, 2024. The status conference addressed both Mesa v. United Airlines, Inc., 22-cv-07369 and Rodriguez v. United Airlines, 22-cv-7374. Plaintiff Mesa was in attendance. In light of the representation that Plaintiff Rodriguez could not attend for medical reasons, see ECF No. 32 , his absence was excused. During the April 29, 2024 conference, the Court addressed Plaintiff Mesa's alleged failure to attend two scheduled IMEs and the parties' failure to jointly raise discovery disputes. Also during the conference, Plaintiffs' counsel represented that the Court had previously denied his request for leave to move to withdraw as counsel; however, the Court clarifies via Text Order that counsel never filed appropriate motions. To the extent counsel wishes to withdraw, counsel must file appropriate briefs. (akw, )

TEXT ORDER: The Court is in receipt of Plaintiffs' April 23, 2024 letter at ECF No. 32 , and Defendant's April 24, 2024 response at ECF No. 33 (both filed in only Mesa v. United Airlines, Inc.,22-cv-07369). Pursuant to this Court's Case Management Order, and prior orders on these dockets, all status letters and discovery dispute letters shall be submitted JOINTLY. The parties have failed to do so. The Court will not consider the issues raised in the unilaterally filed letters at ECF Nos. 32 and 33 (Mesa v. United Airlines, Inc.,22-cv-07369). Instead, the parties MUST meet and confer and submit a JOINT letter by May 6, 2024. As discussed during the April 29, 2024 status conference, the parties shall complete the IME of Plaintiff Mesa as soon as possible. Plaintiff Rodriguez was excused from attending the April 29, 2024 status conference based on the representation that he could not attend for medical reasons. However, an in-person conference with respect to Plaintiff Rodriguez shall be held at a date to be set by the Court. Plaintiffs' Counsel shall be prepared to discuss the scheduling of the same at the next conference with the Court. Finally, during the April 29, 2024 conference, Plaintiff's counsel represented, on the record, that the Court previously denied his request for leave to move to withdraw as counsel. The record does not reflect that this Court denied any such request. For the avoidance of doubt, to the extent that Plaintiff's counsel wishes to withdraw from the case, counsel shall file a formal motion on the docket that cites the applicable caselaw and sets forth sufficient information to enable the Court to make an informed decision. A status conference is scheduled for June 18, 2024, at 11:00 a.m. For the conference, please dial 973-437-5535 and enter Phone conference ID: 839 940 758#. No later than June 11, 2024, the parties shall file a joint letter not to exceed five (5) pages summarizing the status of the case.
