Discovery Hearing Order on Motion to Take Deposition
PAPERLESS Minute Order for proceedings held before Magistrate Judge Lisette M. Reid: Discovery Hearing held on 5/15/2024. Defendant Atlantis Events, Inc's 60 Motion to take Plaintiff's deposition is GRANTED. Although Fed. R. Civ. P. 30(d) limits depositions to one day of 7 hours, the Rule allows for additional time if needed to "fairly examine the deponent." Here, Defendant RCCL used the entire 7-hour deposition day to question Plaintiff leaving no additional time for Defendant Atlantis to question Plaintiff regarding the allegations against it in the Second Amended Complaint. While there is some overlap in the claims against both defendants, it is questionable whether Defendant Atlantis had a fair opportunity to examine the Plaintiff in order to defend against the allegations in the Complaint unique to it. The parties shall agree on a date for Defendant Atlantis' deposition of the Plaintiff. The questions shall be limited to the areas not already covered by previous depositions in this case and in the state court. The deposition shall be conducted via video-conference and shall be limited to one hour and half. Total time in court: 35 minutes. ORDER: Magistrate judge status held. The Court adopts the parties agreed schedule for the November trials. Discussion held regarding setting a discovery schedule for the remaining cases not yet set for trial. Defense counsel estimated approximately 66 depositions will be taken between now and the end of July in both the cases set for trial and those with a fact discovery deadline. Parties shall discuss the cases to go to trial after the November trials. Status hearing set for 6/20/24 at 2:00 p.m. Joint status report due by noon on 6/18/24 setting forth a proposed list of the next batch of cases (after November 2024) to begin preparing for trial. If the parties do not agree on the list, they may set forth their proposed lists in different sections of the order. Parties may appear in person or dial in using the Court's conference call in number. The conference call-in number is 1-855-244-8681 and the access code is 2316 422 1828##. Counsel MUST send an email to Courtroom Deputy, Alyssia Owens, Alyssia_Owens@ilnd.uscourts.gov, at least three days before the hearing. Counsel other than lead counsel appearing telephonically cannot speak during the hearing. There will be no exceptions to this rule. On the day of the hearing, 5 minutes before the case is called, Ms. Owens will go through the list compiled from the emails to make sure all counsel are present by phone. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.
