Law360, Miami (April 19, 2017, 10:30 PM EDT) -- A Florida appeals court on Wednesday retroactively applied a state Supreme Court decision over Allstate Insurance Co.'s personal injury protection policy language on Medicare fee schedules, quashing a lower court's ruling and handing the insurer a win.
After denying Allstate's request for review of a circuit court appellate division's ruling in favor of medical provider Hallandale Open MRI LLC last September, Florida's Third District Court of Appeal reversed course and quashed the lower court's decision, applying the Supreme Court's January decision in Allstate v. Orthopedic Specialists.
