Europe Court Annuls Anti-Dumping Duties For China Solar Co.

Law360, New York (March 16, 2016, 7:52 PM EDT) -- A European court revoked certain anti-dumping duties imposed on a Chinese exporter of specialty glass for solar panels when it ruled Wednesday that income tax breaks the exporter benefitted from in China are not unique to nonmarket economies.

A three-judge panel on the European Union’s General Court unanimously annulled a May 2014 regulation that imposed the duties and agreed that the commission cannot reject an application by Xinyi PV Products (Anhui) Holdings Ltd. to be given market economy treatment because the tax incentives the company received...
