Tire Retailer’s Miscues Don’t Sink Contract Suit, Judge Says

Law360, New York (January 10, 2017, 1:18 PM EST) -- A tire retailer’s repeated failure to produce required discovery responses in a contract breach lawsuit against manufacturer Nokian Tyres PLC deserves monetary and evidentiary sanctions, but the case does not require dismissal, an Alaskan federal judge has found.

U.S. District Judge John W. Sedwick said Nokian could not escape allegations the company breached an exclusivity agreement with Johnson’s Tire Service LLC to sell Nokian-branded tires even though JTS skirted discovery obligations, because the failures were not willful or in bad faith.
