Being There: Defending Depositions

Law360, New York (November 13, 2017, 11:55 AM EST) -- A previous Law360 article addressed preparing witnesses for their depositions. After a witness has been prepared for deposition it is the lawyer’s job to protect the witness, the client and the record — a task that has many challenges, perils and pitfalls. Here are some thoughts based on four decades' experience, for better and for worse.

Show Up

Wherever possible the site should be agreed upon in advance. Never agree to set a deposition at a client’s office. Occasionally clients wish be deposed at their workplace...
