Quidel Strikes Back With Patent Lawsuits Against Rivals

By Marius Meland (February 23, 2004, 12:00 AM EST) -- Only a week after being hit by a lawsuit by rival Inverness in Germany, Medical device maker Quidel Corporation struck back with its own patent infringement lawsuit against Inverness and Applied Biotech over lateral-flow technology used in diagnostic tests.

The complaint, filed on Feb. 20, 2004, in the U.S. District Court for the Southern District of California, seeks a preliminary injunction against Inverness and Applied Biotech products that allegedly infringe Quidel's patented technology.

The lawsuit also seeks declaratory relief relating to the Inverness-owned U.S. patents, and names Inverness Medical Switzerland GmbH and Armkel LLC as defendants, in addition to Inverness Medical...
