PTAB Upholds Claims Of 2 Glucose Monitoring Patents

Law360 (March 5, 2018, 8:27 PM EST) -- The Patent Trial and Appeal Board has found that numerous claims from two patents relating to continuous glucose monitoring are valid after a San Diego manufacturer challenged the patents belonging to a New Hampshire-based rival in inter partes reviews.

The board said in final written decisions Wednesday that Dexcom Inc. failed to show that three claims of U.S. Patent No. 7,146,202 were unpatentable as anticipated or obvious, while holding that six claims were anticipated over prior art. For WaveForm Technologies Inc.’s other patent, U.S. Patent No. 8,187,433, the board held that Dexcom failed to show that all challenged claims were unpatentable...
