Fed. Circ. Wary Of Apple PTAB Appeals In Qualcomm IP Row

By Britain Eakin (August 2, 2021, 6:41 PM EDT) -- Two Federal Circuit judges appeared skeptical Monday of Apple's argument that a three-judge panel can vacate Patent Trial and Appeal Board decisions upholding claims in several Qualcomm patents even though the court held in April their settlement agreement doomed such appeals.

The panel was considering Apple's argument in three consolidated appeals that the court's April decision, which was precedential and therefore binding, failed to fully explain why the threat of Qualcomm suing Apple again when their six-year settlement deal expires isn't enough to show an injury sufficient for standing to appeal the PTAB decisions.
