Meritain Accuses Express Scripts Of Client Data Theft

Law360, New York (January 11, 2012, 8:30 PM EST) -- Meritain Health Inc. sued Express Scripts Inc. in a Pennsylvania federal court on Wednesday, accusing the pharmacy benefit management company of illegally using confidential client information it obtained through their contract to solicit its clients after learning it was losing some of Meritain's business.

An affiliate of Meritain, which administers health care benefit plans for employers who use self-funded plans, signed an agreement with Express in 2005 to have some of its plan components — specifically benefit management for prescription drugs — serviced through Express, according to the complaint.
