Covidien Nets $177M From J&J Unit In Scalpel Patent Suit

Law360, New York (March 28, 2013, 6:32 PM EDT) -- A Connecticut federal judge on Thursday awarded medical supplier Covidien PLC $176.5 million in damages after finding that Johnson & Johnson unit Ethicon Endo-Surgery Inc. infringed three of Covidien's patents covering ultrasonic scalpels.

U.S. District Judge Janet Bond Arterton held that Covidien, formerly known as Tyco Healthcare Group LP, proved infringement of all asserted claims of the patents-in-suit, and while Ethicon succeeded in its defense of prior conception and diligence for various claims, its obviousness defense fell flat.
