Fed. Circ. Orders New Damages Trial In Design Patent Suit

Law360, New York (March 17, 2017, 7:53 PM EDT) -- The Federal Circuit on Friday deemed a new trial necessary to determine damages in a design patent dispute over a loading dock patent in light of the Supreme Court’s recent Samsung v. Apple case.

Nordock Inc. and Systems Inc. must again go to jury trial to determine whether Systems owes royalties on a loading dock ramp or just a component of the end product, the opinion found. The jury will accordingly calculate the appropriate amount of damages from there, the court said.
