PTAB Won't Review Hoverboard Patent

Law360, New York (March 20, 2017, 4:40 PM EDT) -- The Patent Trial and Appeal Board has decided not to review a hoverboard patent that is at the center of district court litigation and a complaint filed at the U.S. International Trade Commission, rejecting a challenge from a Chinese manufacturer that argued the patent is invalid.

In a decision Thursday, the board said Hangzhou Chic Intelligent Technology Co. Ltd. had not shown a reasonable likelihood it would be successful in proving that the patent’s claims were either anticipated or made obvious by earlier inventions.
