US Chamber Backs Del. Chancery's 'Secret' Arbitrations

Law360, Wilmington (December 19, 2012, 2:16 PM EST) -- The U.S. Chamber of Commerce on Tuesday tossed its support behind the Delaware Chancery Court's confidential arbitration program, telling the Third Circuit that a federal judge was “deeply mistaken” in finding that the proceedings are essentially civil trials that must be open to the public.

In an amicus curiae brief filed with the Third Circuit, the Chamber, joined by a coalition of CEOs called the Business Roundtable, said that confidentiality is key in arbitration, and businesses that would otherwise use the program in lieu of litigation...
