GSK's Data Woes A Warning For Others, NY Judge Says

Law360, New York (September 24, 2013, 6:01 PM EDT) -- Law firms and companies that outsource their electronic discovery should heed GlaxoSmithKline PLC's "cautionary tale" and rewrite their contracts, a New York state judge warned Wednesday, as she forced one such vendor to find the pharmaceutical company's apparently lost data.

Judge Shirley Werner Kornreich said discovery vendor Discovery Works Legal Inc. must provide an index of all GSK data it has in its possession by November and ordered its information technology staff to meet with the pharmaceutical company's IT professionals to try to find the data,...
