FDA Hints At Legal Action Against Powdered Caffeine Sales

Law360, New York (December 23, 2014, 12:52 PM EST) -- Distributors of powdered caffeine could soon see themselves on the receiving end of a U.S. Food and Drug Administration lawsuit as the agency weighs its options in halting online sales of the substance, according to information obtained by Law360 on Tuesday.

A source inside the agency told Law360 that the FDA is “looking at our legal options and looking to build a case,” against people continuing to sell pure powdered caffeine even after consumers were warned against consuming the product in July.
