Insurers Can't Scrub Asbestos Claims From Old Policies

Law360, New York (January 30, 2012, 7:39 PM EST) -- A Pennsylvania federal judge on Monday rejected a request by two insurers to alter their coverage contracts with General Refractories Co. to exclude asbestos-related claims in their fight against General Refractories’ allegations that they owed it excess insurance coverage for underlying asbestos suits.

U.S. District Judge Edmund V. Ludwig said Lexington Insurance Co. and AIU Insurance Co. had not adequately proved their claim that the exclusion for asbestos product-related claims had been left out of the policies because of mistakes by its their underwriters.
