Pa. Court Backs Exposure Expert In $1M Asbestos Row

By Matt Fair (September 6, 2013, 2:21 PM EDT) -- A Pennsylvania appeals court on Thursday upheld a $1.3 million award against Hobart Brothers Co. handed to the estate of a welder who developed asbestos-related lung cancer, ruling that a causation expert at trial had adequately forged a connection between the worker's exposure history and his condition.

A three-judge Superior Court panel found that testimony from Dr. Daniel DuPont, a causation expert tapped by plaintiffs in the product liability suit, did not run afoul of a recent Pennsylvania Supreme Court decision rejecting the so-called "any exposure" theory which provided that each and every exposure to asbestos contributed substantially to the development...
